New Hampshire Rules for the Education of Students with Disabilities

  • Student Referral

    Student Referral
    The student is referred by a parent, teacher, or school personnel through the referral process as determined by the school. Once a referral has been made the evaluation and referral process can begin.
  • Disposition of Referral

    Disposition of Referral
    Once referral is made, the LEA contacts the parent or guardian and a multidisciplinary team is put together that will serve as the decision makers for the IEP. The LEA has 15 days to make this happen and to get written consent from the parent or guardian to proceed with the evaluation process. Once consent is given, for either a new referral or a re-evaluation, the LEA has 60 days to complete the evaluation. If there is consent from all parties, the deadline can be pushed back for up to 30 days.
  • Evaluation/Assessment Reports

    Evaluation/Assessment Reports
    The LEA has up until 5 days prior to the IEP meeting for which the evaluation will be discussed to present the parents or guardians with copies of evaluation and assessment reports in regards to their child's academic abilities and challenges.
  • Determination of Eligibility

    Determination of Eligibility
    A meeting is held with the multidisciplinary IEP team, along with the parents for which they were invited when they received the reports. During this meeting, the LEA reviews the reports that should show whether or not the student qualifies for an IEP. If the reports show adverse effect, then a discussion is held with all team members about what the student needs moving forward. The LEA gathers information to include in the IEP. If the student is not eligible, they could be referred for a 504.
  • Writing the IEP

    Writing the IEP
    Once eligibility is determined, the LEA has 30 days to complete the final draft of the IEP. When the IEP is complete, there is usually another meeting for all parties to view the completed IEP, however, this is not required. Sometimes an IEP is sent home to the parent/guardian and to the IEP team for approval. Once signed, the IEP is a lawful document that must be followed by all involved.
  • Parent Extension

    Parent Extension
    If the parent/guardian does not agree with the decision, the parent has 14 days to indicate their refusal and it must be in writing. The parent has the right to an agreed up 14 day extension.
