Public Law 92-142 Created & Signed by President Gerald Ford
This included a classification titled SED (Seriously Emotionally Disturbed). -
PL 92-142 changed to IDEA
Added social work and counseling to services. Still excludes students who are socially maladjusted or who have conduct disorders. -
IDEA Amendments Signed by President Clinton
Classification label changed to Emotionally Disturbed (ED). Provision added that a student may not be expelled from school for misbehavior if the behavior is caused by the student's disability. Congress suggests PBIS. The federal definition of EBD was still vague so many states provided clarity to help with proper evaluation and identification. -
IDEA Amended
Requires the IEP committee:
-Considers Positive Behavior Intervention and Supports
-Does an FBA if there is no behavior plan present and the student has been removed for more than 10 school days for behavior that ends up being a manifestation of their disibility
-Does an FBA if there is behavior that causes long term removal from their current placement
