    1. Separate but equal is NOT EQUAL.
    2. Included as part of the CIVIL RIGHTS cases.
    3. Illegal to discriminate based upon RACE, RELIGION, and GENDER.
  • Association for Children with Learning Dissabilities

    Association for Children with Learning Dissabilities
    1. Currently known as Learning Disabilities Association of America LDA.
    2. Provided parents and students a group of people struggling with similar issues.
    3. Currently has chapters scattered throughout every state.
  • Elementary and Second Education Act

    Elementary and Second Education Act
    1. Known as ESEA
    2. Signed into law by Lyndon B. Johnson.
    3. EQUAL access to education for ALL students.
    4. Provided FUNDING for ELEMENTARY and SECONDARY education students who struggled financially.
    5. WAR ON POVERTY

    Mills vs. Board of Education
    1. Students were excluded from public education for having. behavioral problems, mental retardation, emotional disturbance, of hyperactivity.
    2. Parents and students filed a suit arguing that the DOC had. FAILED to provide and avenue to RECIEVE their GUARANTEED RIGHT to EDUCATION.

    1. Prohibits DISCRIMINATION based of DISSABILITY.
    2. Applies to ELEMENTARY and SECONTARY education.
    3. Provides protection to ALL students with DISSABILITIES.

    Public Law 94-142
    1. Guarantees FREE APPROPRIATE education to EACH child with a disability.
    2. ALL STATES that accept federal moneys for educations are REQUIRED to provide education to ALL students.

    All Handicapped Children Act
    1. States PROVIDE SERVICES from BIRTH to families with disabilities.
    2. Revision of PL 94-142.
    3. Changed Assistance to start at birth rather than 3 years of age.

    1. Became the first CLEAR PROHIBITION of discrimination based on disability.
    2. Effective in not only SCHOOLS but ALL WORKPLACES and ENVIRONMENTS.

    Education for All Handicapped Children act becomes IDEA
    1. Ensures that ALL students have access to the SAME curriculum .
    2. 3rd re write of PL 94-142
    3. Strives to INTEGRATE those students with disabilities more with "normal learners" to limit separation.

    IDEA becomes IDEIA
    1. Raises STANDARDS for TEACHERS who teach SPECIAL EDUCATION.
    2. 3rd rewrite of PL 94-142
    3. ENCOURAGES teachers to INSTUCT in a LEAST RESTRICTIVE ENVIRONMENT to better BENEFIT the STUDENT.
