ESEA - Elementary and Secondary Education Act
ESEA authorizes state-run programs for schools who are eager to raise the academic achievement of struggling learners. ESEA address the challenges students who live with disability, mobility problems, learning difficulties, poverty, or who need to learn English face. This Act provided an initiative to help low income families and any child who needs support to benefit from an education. -
Mills vs. Board of Education of the District of Columbia
The case was built because of the failure of the District of Columbia to provide education and training to students with disabilities. The case also argued the unjust excluding, suspending, expelling, reassigning and transferring of these children from regular public school classes without affording them due process of law. Educational Amendments Act
Signed into action by President Gerald Ford. The Educational Amendments Act increased Federal spending for education of disabled children. It provides state funding even for students who are gifted and talented. -
EAHCA - Education for All Handicapped Children Act
The EAHCA required all public schools accepting government funds to provide equal access to education for children with disabilities. It required the creation of an educational plan (IEP) that would emulate the education experience of other students with no disabilities. Honig v. Doe Case
A California school board had violated the EAHCA when it indefinitely suspended a student for violent and disruptive behavior that was related to his disability. Noting that the student had a right to “a free appropriate public education,” the district court was prohibited from suspending any students with disabilities from school for more than five days when their misconduct was disability-related. Additionally, it became prohibited to expel students for that same reason. -
ADA - Americans With Disabilities Act
This act prohibits the discrimination of people with disabilities. Businesses and nonprofit service providers that are public accommodations, privately operated transportation, and commercial facilities, restaurants, retail stores, hotels, movie theaters, private schools, doctors' offices, homeless shelters, and more, are upheld to the standards of the ADA. IDEA - Individuals with Disabilities Education Act
This Act replaces EAHCA and provides more help for students with disabilities. IDEA establishes person-first language and expands special education services. It adds autism and traumatic brain injury categories, and requires transition services and planning. Children with disabilities are educated with children who are non-disabled in a least restrictive environment, and special classes, separate schooling, or other occurs only if the education in regular classes is unsatisfactory. -
NCLB - No Child Left Behind Act
This law also established a rigorous accountability system for states and public schools and increased flexibility in use of federal funds.
In addition, NCLB required that students have to be taught by highly qualified teachers in environments that are safe, drug-free, and conducive to learning. IDEIA - Individuals with Disabilities Education Improvement Act
The primary goal of IDEIA is to improve outcomes for students with disabilities. By emphasizing the requirements of the special education process, using qualified personnel, evidenced based practices, and altering eligibility requirements, IDEIA improves the original IDEA. Also it increases funding for early intervention services for students who do not require special education. -
ESSA - Every Student Succeeds Act
This Act provides equal opportunity for all students. It also provides additional opportunities for schools when students are not progressing at a satisfactory rate. It improves teacher quality and supports instruction for English language learners.
