    The Pennsylvania Association for Retarded Children (PARC) wanted for students with mental disabilities to be able to attend school with other students and other special education students. Due to the strengths of the evidence, the Commonwealth of Pennsylvania and the court came to a settlement in 1972, tasking the State to provide a free public education to all children between the ages of six to twenty-one.

    Following the PARC vs. Pennsylvania of Commonwealth, there was a case brought before U.S. District Court OF D.C. by the family of Peter Mills, a 12 year old with behavioral issues. The school district excluded Peter from school due to his behavioral

    Issues. District Court Judge Waddy decided that no child should be denied an education without an equal solution modified for the child’s needs. It became unlawful for the district to practice excluding children.
  • Timothy W. vs. Rochester N. IL School District (1980-1989)

    Timothy W. vs. Rochester N. IL School District (1980-1989)
    Timothy W. suffered from several complex developmental disabilities and his mother attempted to obtain services for him. He was receiving some services,but not any educational services because the district felt he was severely handicapped and he was not “capable of benefiting” from education. His parents disagreed and sued the Rochester School district and because of the EACHA (Education for All Handicapped Children Act) Due Process, his mother fought for 9 years and received an IEP.
