IDEA/ Child Find Regulation
Child Find requires states to come up with a system for finding and identifying students with disabilities. This responsibility usually falls upon individual school districts. The school has an obligation to find out if these students have a disability under IDEA. Child Find is an ongoing process and is the obligation of the school districts. -
Response to Intervention/ IDEA 2004
What is RTI?IDEA made changes in the request process for a student suspected of a learning disability. School must assure, prior to the request, that the student has been provided appropriate, research based instruction in a regular classroom by qualified facutly or staff.This Response to Intervention can be used by school districts as part of thier referral process. This process cannot be used to delay an evaluation or an individual education plan. No timeline has been placed on the RTI process. -
Disposition of Referral
Disposition ReferralDisposition of Referral is the first meeting of the IEP team. This should include at least:parent(s), regular education teacher, special education teacher, and other adminsitration or certified professional. At this meeting the student's data that has been collected will be reviewed and the next steps will be determined by the team.Timeline for the team is to meet 15 days after referral for the Disposition of Ref. -
Signed Parental/Guardian Consent for Evaluation
Parental Consent
Parents/Guardians must sign a consent for their child to be evaluated before being considered for special education services. The evaluations must take place 60 days after the signed consent. -
Evaluation
Types of Evaluations
The evaluation(s) must be obtained within 60 days of the signed consent. In some instances the timeframe may be extended with parental permission. When the evaluation has been completed , and the child is found to be eligible for special education, an IEP meeting must be held within 30 days. -
IEP meeting-Evaluation Meeting with Eligibility Determination
Expectations of an IEP meeting.
Parents need to be informed of meeting at least 10 days before scheduled meeting. This meeting includes all members of the IEP team. Eligibility should include all evaluations, any and all classroom data, and RTI data collected.
After the IEP meeting there is a 10 day transitional period where the parents can adapt or change the IEP. -
Development of an Individual Education Plan

The team ,including the parents, will discuss methods and intervention that will be linked to goals for the student. IEP's must be written clearly and consicely in order to "move" with the student if they leave the district. The IEP must be written with the individual child in mind and puts aside any financial constraints. The IEP will be implemented upon parent signature and start date. -
Placement
Placement of Students with an IEP
The placement of the child is determined. How the child's needs will be best met is a priority. Considerations are given to pull out versus in-class support. Amount of days and times of services need to be listed as well as the placement of these services. -
Progress Monitoring
Progress Monitoring for the student with an IEP
Students on an IEP need to be monitored on a regular basis and progress notes need to be sent home no fewer times than the regular education reports go home. The data collected will be used to determine if interventions are working or if further modification/special education methods need to be implemented for the student. -
One year and Three Year Re-evaluations
Student annual and three year evaluations.
Students on an IEP should have an annual meeting in regards to their IEP. The annual meeting is used to make any necessary changes. A student that has been serviced for three years will have a reevlaluation to determine eligibility for special education services. Parents can also ask for reevaluations any time within the three years.
