Special Education Laws

  • The Elementary and Secondary Education Act (ESEA)

    This law was passed to help fund schools to equip equal opportunity for education. This helped by giving funds to communities experiencing poverty to ensure each student had access to equal education.
  • Sec. 504 of The Rehabilitation Act of 1973

    This is a law of civil rights that protected those with disabilities from discrimination and harassment in receiving benefits or participating in programs. This also helps give them an opportunity to the equal rights and capabilities that is accessible to everyone.
  • Free Appropriate Public Education (FAPE)

    This law was passed to help give free education to handicapped individuals. The education matched their needs and levels of education.

    Individuals with Disabilities Education Act (IDEA)

    This law was created to give individuals with disabilities free education. This education is special education but also includes alternative services for those depending on their needs.
    The alternative services can take place at or outside of a school setting.
  • Education for All Handicapped Children Act

    This law was passed to help young children with disabilities be allowed access to the same education as students in the same age groups. Many states did not want to comply with the rules so this law helped them go into effect since they were threatened to lose federal funds for the state.

    The Tech Act

    The Tech Act is also known as the Technology-Related Assistance for Individuals with Disabilities Act. It was published in 1998 and revised in 2004. The purpose of this law was to help disabled and handicapped people have access to devices that accommodate their needs. Examples can be AC devices (devices to help communicate), hearing aids, etc. These types of devices are given to them by the people whom they get their services from.
  • No Child Left Behind Act 2001

    This law was passed to ensure all students were able to succeed based on their IEP and capabilities. All students were able to practice common core subjects as well as take tests to show their proficiency based on their levels.
  • Individuals with Disabilities Education Improvement Act of 2004

    This law was created to help fund students and individuals with disabilities. The funds were given by the government and had special requirements to qualify.
  • Every Student Succeeds Act (ESSA)

    This law was passed by President Obama, it was basically a revised version of the No Child Left behind Act of 2001 (NCLB). This law helps educators and service providers better accommodate student needs and ensure students' success. If a student succeeds then so do facility rates.
  • Endrew F. v. Douglas County School District

    This was a case that helped give more to students of disabilities based on their IEP's. Endrew's parents fought to get more for him especially because they wanted to move him to a private school. The school claimed to be giving the student all the required services as they were exceeding or doing better than peers and the Supreme Court ruled in the family's favor. This helped highlight how over time students of disabilities can be better challenged and are always given room for improvement.
