Special Education Landmark Cases

  • Pennsylvania Association for Retarded Children v. Commonwealth of Pennsylvania-1972

Pennsylvania did not have public education for physically and mentally handicapped children. The Commonwealth of Pennsylvania ordered that public education should be available to all children, regardless of their physical or mental hindrance. This legal ruling has supported the needs of students with disabilities because it gives all students the right to a public education. https://www.slideshare.net/AngieCheatham/court-cases-6780307
  • Smith v. Robinson 1984

The Cumberland Rhode Island School was taken to court by parents of a special education student. The school removed the student from a program for special needs children. The court decided that parents who win in a special education case are reimbursed the legal fees they had to pay. This legal ruling has supported the needs of students with disabilities, because now parents are protected against paying legal fees after they win a case.
  • Honig v. Doe 1988

Two students who were emotionally disturbed were suspended for good after displaying violent and disruptive behavior, when their behavior was related to their disabilities. Court ruled that a student couldn’t be denied education when their behavior is related to their disability. This legal ruling has supported the needs of students with disabilities, because their misbehavior is a result of their disability. Students with disabilities don’t choose to misbehave.
