    U.S. Supreme Court- School Committee v. Dept. of Educ., 471 U.S. 359 (1985)

    This case guaranteed the procedural safeguards of free appropriate public education for children who are handicapped. The Education of Handicapped Act passing included parents' rights to participate in the IEP development for their child. This the child was not getting the educational needs and placement met in public schools then parent(s) are able to enroll their child into a state approved private school. This school would be reimbursed for the child who is attending.
  • 1972 Mills vs Board of Education

    Was a class action law suit that was brought on behalf of seven children and others who resided in the District of Columbia. Students had been denied or excluded from educational services. The court ruled in favor of the students and the school had to come of with the funds to make the necessary changes to have services available for all students of special needs.
  • OCTOBER TERM, 2006 WINKELMAN V. PARMA CITY SCHOOL DIST.

    In this case Jacob's IEP was deficient in regards to his education and an accordance to Disabilities of Education Act Jacob has the right to a free appropriate education with all needs met for his disabilities. Jacob Winkelmen's father unsuccessfully appealed through IDEA's administrative review process in regards to his son's education. However, the IDEA grants parents independent, enforceable rights and resolves the question whether a parent has tights under the Act too.
