Burlington v. Massachusetts Department of Education
Michael Panic was given an IEP that his school was unable to accommodate. His parents decided to remove him from public school and place him in private school. Per the courts if a student was moved to a private school they would be reimbursed. The courts felt that the reimbursement equaled the same amount of money that would have spent in a public school if the IEP had been proper. Parents no longer have to keep there kids in a school that doesn't benefit them by going private.
