Due to a buildup from three previous cases which were Pennsylvania Association for Retarded Children (PARC) vs. Pennsylvania (PA, 1971) and Mills Board of Education (DC,1972) they came together to form a right for children with disability to have a free and public education in a least restrictive environment by incorporating an equal protection guaranteed from the 14th amendment.
