Special education not treated equal
. In the 1960's access to an appropriate education was denied for most students with disabilities. Students where housed in state institutions and schools only education 1/5th of students whit disabilities.Student with disabilities where not allowed to be in the classroom with students that do not have disabilities. -
Larry P. v. Riles (California).
IQ test where given to students to see where they should be placed. .Due to these tests, many African American students were wrongfully placed in special classes for mildly retardation. An African american student took superintendent Riles to court to address the racial biases of the tests. Board of Education of the Henrick Hudson School System v. Rowley
In this case it opened the doors of public schools for students with disabilities. Rowley, a deaf kindergarten students was refused a sign interpreter; her parents the school on her behalf for violation of the Education of All Handicapped Children Act of 1975. The Act requires federal funds to provide a “free appropriate public education” to all handicapped students. Zobrest v. Catalina Foothills School District
The court held that provision of a sign language interpreter in a parochial school was not an entitlement under IDEA. . When transferring to a private Catholic school, the interpreter was no longer to be available for Zoburst.
