Diana v. California State Board of Education
Mexican American students were placed into Special Education classes at high rates. In this case, nine students from primarily Spanish speaking homes were categorized as mildly retarded based on results from invalid IQ test. A class action suit was filed, stating that students had been improperly tested and the results should be invalid. An agreement was made to retest students in their native language. This was the correct and ethical decision,being that previous tests were biased. -
Americans with Disabilities Act
Gives protection for all people no matter their age or disability. Known as "the Civil Rights Act for the disabled", the ADA applies to many venues such as public services and transportation. An ADA requirement is for all types of public accommodations, for example, football bleachers need to be accessible to individuals with disabilities. The ADA is focused on inclusiveness, a person's physical or mental disabilities should not exclude them from anything that is created for everyone. -
No Child Left Behind Act
Signed into law by George W. Bush, this act reauthorized the Elementary and Secondary Education Act and set new academic standards for America's youth. Based on 4 education reform principles, NCLB held schools and teachers accountable for the academic achievements of every student including those in special services. Alhtough this at may have seemd fair on paper, in reality it was baised adn theire was too much pressure placed on school districts and teachers.
