  • Brown vs. Board of Education

In this landmark judgment, the Supreme Court declared racial segregation of students in public schools to be unconstitutional. It overturned the "separate but equal" tenet established in the 1896 Plessy v. Ferguson case and marked the end of officially sanctioned racial segregation in American schools. Although this isn't directly related to special education yet, it will be used in later years to compare "separate but equal" classrooms for students with disabilities.
  • Elementary and Secondary Education Act is passed

To address the unequal access to education for disadvantaged students, Congress passed the Elementary and Secondary Education Act (ESEA) in 1965. With the aid of this historic legislation, disadvantaged students are now entitled to high-quality education, just like their peers.

  • Mills v. Board of Education of District of Columbia

According to Mills, no kid could be refused access to a public education due to "mental, behavioral, physical, or emotional handicaps or deficiencies." Also, according to the court's decision, students with impairments must receive a public education even if they are unable to pay for it. As per the ruling, "all children have a right to a free public education and training that is suited to their learning capacities."
  • Education for All Handicapped Children Act is passed

The Education for Handicapped Children Act guaranteed a free and "appropriate" public education to each and every child with a disability in all states across the country. This act was significant because it provided students with disabilities the opportunity to have a "quality" public education- at least that was the idea.

The No Child Left Behind Act reauthorized the Elementary and Secondary Education Act. • Every Student Succeeds Act is passed

The ESSA updated but left in place regulations relating to the recurring standardized examinations administered to students, replacing its predecessor, the No Child Left Behind Act. States must set "challenging" academic standards in reading, math, and science. This means that a state's curriculum needs to equip learners for success in both college and the workplace. States must also enforce these standards on every student, even those who have cognitive and learning disabilities.
