Dredd Scott was a slave. He went to a free state and sued for his freedom. His argument was "I'm in a place where slavery is illegal. I'm a slave. That means I'm free!" His case went all the way to the Supreme Court. The Supreme Court said this, he was property. Property has no rights. He did not have the right to sue someone. He is not free.
