    Diana v State Board of Education
    The children were unable to comprehend the materials on the test for no other reason than lanuage differences. The court ruled this situation violated the Equal Protection Clause of 14th Amendment of US Constitution because the children were not given equal protection based on the language they spoke.     Board of Education v Rowley
    In 1977 Amy Rowley's parents filed a complaint with the Civil Rights Division of the Dept. of Health, Ed., and Welfare accusing the school district of discrimation against their deaf daughter. They were seeking a sign language interpreter. An impartial hearing ruled that Amy was receiving "aappropriate" education under the now IDEA .The Rowley family appealed the decision. By 1982 the Supreme court ruled that Amy was receiving FAPE through the school district.

Her parents wanted to increase the time she spent in the general education classroom and they requested full-time regualr classroom with an aide. The district rejected the request stating Rachel's disability was too severe. The district court ruled that Rachel would receive benefits from being in an regular classroom with support and curriculum modifications.
