Per IDEA Part C, Sect. 631__, Schools must attempt to seek out any children in the school community that might need services. This includes reaching out in the public and private school environment, migrant populations, children already receiving related services or are at risk.

When a parent, teacher, or other interested party feels they have identified a child who needs special education services they can make a writte referrel to the Local Education Agency (LEA). Within 15 days of receiving a written referral the LEA must call an IEP meeting wich is referred to as the disposition of referral to decide whether a child is eligible for services or whether the child is to be evaluated further.

IEP Team meets within 15 days of receipt of referral to LEA to discuss the disposition of the referral or whether the child needs services, other interventions, or further evaluation.

Parents must be notified within 15 days of the decision of the IEP team. In this case it is a request for consent to proceed with furhter evaluation.

Parents have 14 days to respond to IEP Team decision for further evaluation.

Evaluation is conducted and parents must be presented a copy of the results and the eligibility determination within 45 dyas of parental consent for evaluation.

The IEP has 30 days from the eligibility determination to develop and Individualized Education Plan.

Placement recommendation can occurr concurrently with IEP development within 30 days of the determination of eligibility. Parents have 15 dyas to respond to the recommendation.

Parents have 15 dyas or sooner to respond to suggested IEP and placement. These can happen concurrently or not.

Special Education services can begin immediately after parental consent.

The IEP should be reviewed at least once per year.
