  • Once a child is referred, in how many days must the team meet?

  • What is the next step after this meeting which is called “Disposition of Referral”?

Per NH Standards for Students with Disabilities (Ed 1107), evaluations must be finished within 60 days of parental consent or within the state's timeframe if different. Additionally, the assessment must determine if the child has a disability under §300.8 and evaluate the child's educational needs. ED1107 (Found on page 67; 76 if viewing on web browser)
  • If the parent asks for an extension, what is the maximum number of days the team can take for the extension?

The parent has 14 days from the school district’s written request to respond. This time limit can be extended by mutual agreement. If there's no response within 14 days or the agreed extension, the school district can show it took reasonable measures to obtain consent. NH Procedural Safeguards
  • What happens once the evaluation is completed?

The team determines eligibility (ED 1108) after evaluating the child by: (1) Assessing with the parent whether the child meets the disability criteria in §300.8 and identifying educational needs; (2) Providing the evaluation report and eligibility documentation to the parent at no cost. A child cannot be deemed disabled solely due to inadequate reading instruction. ED1107
  • If the team determines the child does have a disability, how many days does the team have to write an IEP?

A meeting to develop an IEP for a child is conducted within 30 days of a determination that the child needs special education and related services. UNDERSTANDING THE ELIGIBILITY
