1) When the copyright has expired.
2) When permission has been obtained from original author.
3) When utilization of the work qualifies for the Fair Use exemption. -
What is public domain?
Public domain consists of works whose copyright has expired. -

What is fair use?
Fair use states that under certain conditions, copyrighted works may be used for teaching, research, scholarship, criticism, journalism, parody, and similar purposes without specific permission from the copyright holder. -
Suggested Guidlines for Legal Practice
1) limit public access to work
2) link to existing material when possible
3) reproduce only the minimum amount needed
4) use the format that is least easily copied
5) always credit the source of the work
6) ensure that the work relates to instruction
7) obtain permission for works used repeatedly
