  • No Electronic Theft Act

    No Electronic Theft Act
    The act states that criminal prosecution is authorized to those that violate copyright rights in that the purpose is for the users advantage or even private financial gain and to an extent cheating as well on school matters. The case of David LaMacchia is the reason the legislation was made as in 1994 LaMacchia was caught allegedly violating copyright rights as a hobby however the existing law did not apply to the case. Thus, the NET Act was made by Congress to address the problem.

    The Act creates a standing in which it is much more plausible and accountable for people that are infringing on copyright. As such, it also helped in smoothing out the NET Act of 1997 in increasing criminal penalties for similar offenses. Representative Howard Coble stated that users are seemingly more ignorant and are not willing to abide by the laws and act of the NET Act of 1997 so this act would create a much more imposing and stronger bearing of accountability of those that infringe.

The Content of the information can be disclosed to those of local, state of federal governmental entities. This can only be done if the person or individual that is apart of the ISPS is a immediate threat which could involve death or harm to others.

    The Act states that there is to be an ongoing partnership between public-private sectors that is voluntary to improve cyber security research and development, workforce development, education, and public awareness. The Act works in developing the role of the National Institute for Standards and Technology.

    The act works in that companies and the government are able to share personal information much easier mainly in cases of cyber security threats. Without requiring the act the bill would create a system for federal agencies to receive threat info from private companies. As such it establishes stronger cyber security with companies and federal agencies being able to work within the flow of internet traffic and look into information that may be considered harmful

    The act was signed in and created by Donald Trump and establishes a standalone and very own federal agency. With this the Department of Homeland Security overseeing the agency. The previous agency being the National Protection and Programs Directorate (NPPD) was formed in 2007 with the CISA carrying on the mission and the main ideals of the NPPD.

After Microsoft vs. United States the response of Microsoft owning the data and how the SCA did not cover any data stored outside of the United States; Senator Orrin Hatch had attempted to create a legislation prior with the LEADS Act in 2015 and the ICPA in 2017 with the CLOUD Act being a culmination of both the acts and Hatch's work coming to full fruition.
