FedExed FMLA Status Letter
I sent this letter to inform Tim that he had exhausted his FMLA protection on 4/19. I reminded him that we spoke on the phone and he had informed me he would be returning to work on 4/19 but failed to do so. This letter also indicated that if he so requested, we would consider an additional non-FMLA leave of absence and I enclosed the Request for LOA form. I believe this prompted his telephone call to me on 4/27. -

Ervin asks to return to work
Tim called me after receiving FMLA status letter, requesting that he return to work immediately. I told him that according to this Dr.'s note from 4/26 he was totally disabled until 5/24. I told Tim he could not return until he had a Dr.'s note specifying so. -
Dr.'s Note
Tim produces a Dr.'s note that differs from the "totally disabled through 5/24" The NEW Dr.'s note states:
May RTW from 4/30-5/31 with restrictions: no lifting over 50 lbs.
10 minute rest/hour
We accomodated these restrictions. -
W.C. Injury #2
Upon Tim's first day back to work from his FMLA leave, he complains of light headedness, nausea and is called into Teleplus as an incident only: non-work related. Tim had not yet begun his work and did not claim this sickness was a result of the work place. He was transported to an acute care hospital from work as a result on 4/30. -

Ervin returns to work
Dr.'s release from 5/3 indicated that Tim could return on 5/10. This was his first day back to work since the 4/30 nausea incident. He did not indicate, request or submit any accomodation needed. -
