Three landmark cases concerning Special Education

  • Diana v. California State Board of Education

    Diana v. California State Board of Education
    This case addressed the over-representation of Mexican American in Special Education. Mexican students were giving IQ test in English oppose to Spanish. These students were labeled as having mild retardation based off a fraudulent IQ test which was a cultural bias toward these children. The opponents of the case agreed that these students should be tested again in their native language. This case addressed cultural bias and language barriers in the school system.https://lawaspect.com
  • Pennsylvania Association for Retarded Children v. Commonwealth of Pennsylvania

    Pennsylvania Association for Retarded Children v. Commonwealth of Pennsylvania
    This case was monumental because the state of Pennsylvania denied children with disabilities a public education. A group of children with various issues was denied free public school education. Although the judge did not find fault in either party, the judges ruled that all children regardless of their disability have the right under the law to attend free public education and denying students with a disability a public education is a violation of their 14 amendment rights.
  • Mills v. The Board of Education of the District of Columbia

    Mills v. The Board of Education of the District of Columbia
    In this case, the District of Columbia school board denied children with disabilities the right to receive a public education. The opposing side argument was that they didn't have the funding to provide quality education to these students. The parents argue that denying these students an education violates the rights.
