    CA State Board Of Education was sued due to allegedly placing Spanish speaking children in EMR classes. The plaintiffs were 9 Mexican-American children that came from homes that that spoke Spanish. They were not able to pass the "SBI" IQ Test. It was later found that they didn't understand the test because they did not speak english. The state later agreed the the children should be tested in their native language. This helped children get placed.

    The Board of Education of District of Columbia were sue for labeling children as "exceptional" meaning that they handicap in some way. They were denied education.They first reach a settlement to fix this problem but never did, it went to the supreme court.They ruled that they would have funding for the programs need to to teach children with disabilities. Also that all children will be created equally.

    Frederick L. student was the plaintiff who argued that the Board Of Education of Philadelphia, et al. The Commonwealth of Pennsylvania did not have remedial programs for children with a specific learning disability.
