The purpose of this memorandum is to explain policy issues regarding the responsibility of school districts required to provide equal educational opportunity to national origin minority group children deficient in English language skills. -
Lau v. Nichols
lau v nichols civil rights case that was filed by Chinese American students who lived in San Francisco, California and had limited English proficiency. The students claimed that they were not receiving sufficient help in school due to their inability to speak English. They claimed that help based under Title VI of the Civil Rights Act of 1964 because of its ban on educational discrimination on the basis of national origin. -
The Equal Educational Opportunities Act (EEOA) of 1974

This includes racial segregation of students and requires school districts to advocate in behalf of students' equal participation. -
Rios v. Reed
In the Rios v. Reed case. the court found Pastchogue-Medford School District’s bilingual program inadequate, in the school professionals’ knowledge of bilingual teaching methods, language assessments and placement procedures, native language curriculum materials and instruction. -
Castaneda v. Pickard

The court set in place a three-part test to determine wether a school district takes the appropiate actions to overcome language barriers that many language minority students face. -

This case required State Educational Agencies to set guidelines in regards to the sevices provided to limited English language students and ensure that those guidelines are consistently monitored and enforced. -
Plyer v. Doe
In 1982, the Supreme Court ruled in Plyler v. Doe, that public schools were prohibited from denying immigrant students access to a ffree public education. The Court ruled that undocumented children hold the same right to a free public education as U.S. citizens and permanent residents. Undocumented immigrant students are obligated, to attend school until they reach the age mandated by state law, as are all other students. -
