  • 1972 Mills v. Board of Education of the District of Columbia

    Mills party believed that all students should receive an education regardless of disability (Cheatham, 2011). Board of Education of the District of Columbia as if this were not the case (Cheatham, 2011). This case set the standard that all students be educated a based on the students needs (Cheatham, 2011). This solidified that standard that all children with disabilities receive free public education (Cheatham, 2011).

  • 1984/1985 Burlington School Committee v. Department of Education

    Parents of special needs student placed child in private school because public school wasn't accommodating (Cheatham, 2011). The school district was not accommodating properly (Cheatham, 2011). The courts made the district pay for the private schooling (Cheatham, 2011). If the school can't provide adequate services, they may have to pay for private schooling (Cheatham, 2011).   • 1988 Honigv v. Doe

    The school tried to indefinitely suspend two students for a violent encounter (Cheatham, 2011). The students were ED (Cheatham, 2011). The courts would not have this. The court ruled that this couldn't happen based on a disability (Cheatham, 2011).

  • How Did These Rulings Support Students with Disabilites?

    These court rulings have supported the needs of students with exceptionalities by forcing schools to accommodate. Rather than pushing these students out of the school settings, schools must work to educate and support students with disabilities. These court hearings support our youth/students with disabilites rather than counting them out.
