Recieving Manager- Forced to Quit
An employee was forced to quit his job because he was assaulted by the store manager. Since he was in fear of losing his job, he didn't report the incident to anyone. Human Resources are all family/related (which breaks their own at will employment policy). -
Recieving Manager- Filed for UC benefits
He had filed for unemployment benefits and showed his burden of proof and was deemed elegible under section 402(b) from Pennsylvania UC. -
Receiving Manager- Finding Facts- Approved UC
1.) Receiving Manager- was last employed on December 22, 2012.
2.) Voluntarily quit because he was being treated badly by his manager.
3.) There was a reason ecpectation that the employer could have provided an alternative to resolve the situation.
4.) Claimant informed the employer of the reason for leaving.
5.) Claimant exhausted all alternatives prior to quitting. Stated by UC law: In situations where the claimant voluntarily quits employement, you must prove you had a compelling reason. -
Receiving Manager- Proof of Burden
PA State UC law: In situations where the claimant voluntarily quits employment, the burden is on the claimant to prove that he/she had necessitous cause. (Section 402b) Stated in documentation: The claimant had a necessitous and compelling reason for quitting and exhausted all alternatives prior to quitting. He has sustained his burden of proof and benefits must be allowed under Section 402(b) of the PA UC Law. -
Receiving Manager- ShopRite Appeal
He had recieved an appeal notice stating that ShopRite of Hatfield had appealed the referee's decision and we would have to go to a onsite hearing and ShopRite could prove that he was never once touched by the store manager. And could prove that he was insubordinate. -

Finding Facts/DecisionThe referee decided to reverse the decision and favored ShopRite. Therefore losing all benefits. -
Misc- Phone Calls
Recieved a few phone calls from current ShopRite employees stating that they are going through the same thing that we have been explaining this whole time.They have also been going rounds with management because they couldn't go to their HR department and report the incident's because there isn't one except management (and they're family). -
Misc- Employees Coming Forward
It has come to my attention that more employees are stepping forward stating acts of violence from the store director.
