Ernesto Miranda was arrested in his home, taken to the local police station with charges of rape and kidnapping. Ernesto was not made aware of his rights to counsel prior to questioning. He signed a waiver typed by a disclaimer stating he had full knowledge of his legal rights, when he actually didn't.

Denied

Mar 27, 1963

Miranda was denied counsel at his preliminary hearing. His lawyer objected to the use of his signed confession as evidence, but it was overruled.

Ernesto Miranda was once again conviceted of rape and kidnapping, this time recieving a 20 year sentence

Miranda Goes Under Appeals

Jun 12, 1965

to the Arizona Supreme court claiming that the police had illegally obtained his confession. The court disagreed and upheld his conviction. Miranda appealed to the US supreme court in 1966.

Violation of Rights

Jan 23, 1966

Flynn and Frank submitted their argument stating that Miranda’s 6th amendment was right to counsel had been violated. Two weeks later, Arizona responded by stating that his rights had not been violated.
