Juvanille convict, Evan Miller, was born in Lawrence Country, Alabama on November 2nd, 1988. He grew up under violent abuse, severe neglect, and poverty with his two drug-using alcoholic parents. Miller than began using drugs and drinkings at age 8 and recieved mental health treatment throughout his childhood.

The crime occured at a trailer park in Alabama, where Miller after partying with the neighbor began to steal money from him when he awoke and caught him in the act, grabbing him by the throat, Miller then began beat Cannon (victim) to death with a baseball bat.

The Supreme Court Rules to abolish the death penalty entirely for minors under the age of 18, due to the Roper vs. Simmons Case. Therefore, the death penalty for Miller was completely out of the question and had been for years and since the abolishment of the death penalty for minors 16 and under in 1988.

The Eighth Amendment prohibits a sentencing scheme that requires life in prison without the possibility of parole for juvenile homicide offenders. Due to Millers mental maturity the state then moved Miller to the Alabama Court of Criminal Appeals where he could be charged as an adult with murder and a course of arson.
