    In May 2021, lawmakers in Illinois passed a bill that prevents police from lying to children during questioning in an effort to prevent false confessions. Illinois is the first state to pass such a law. The bill was inspired by Brendan Dassey’s conviction.

    The witness, delivery driver Thomas Sowinski, says that he saw Bobby Dassey and a man pushing a Toyota RAV4 on the morning of Nov 5th, 2005. Thomas claims that he delivered newspapers and had to swerve to avoid hitting bobby, who had tried to stop Thomas from leaving the property. “Bobby Dassey looked me in the eye and I could tell with the look in his eyes that he was not happy to see me there,” Thomas reported the matter but an officer said they already knew who did it.

    On July 8th, 2021 Kathleen tweeted that Steven Avery’s mother, Dolores Avery had passed away. She died a day before Steven's 59th birthday which is on July 9th, 2021.

  • Zellner claiming Brady violation

    Zellner is also claiming a Brady violation because a call to dispatch from a witness claiming to see the vehicle leave the property was not provided to previous counsel. Zellner says her office received the “previously suppressed” call that was placed on Nov. 6, 2005. The recording had never been disclosed to the trial defense. Zellner says the existence of the call negates trial testimony that Halbach’s RAV-4 never left the property and that Avery was the last person to see Halbach alive.

    March 2022 attorneys Dean Strang and Jerry Buting issued an open letter to Gov. Tony Evers highlighting the alleged injustices in Dasseys case and urging the governor to commute Dasseys sentence. In their letter, they call out Evers for not exercising his constitutional power of executive clemency. While Evers has granted numerous pardons- vacating convictions after a person has served their time and been released - he has never commuted or shortened the sentence for someone still incarcerated.

Zellner claims that the witnesses can provide “new and undisputed evidence that directly links a third party suspect. Zellner claims the suspect killed Halback and planted evidence in her vehicle, of Avery’s blood on the seats and dash,DNA on the hood latch. Zellner says the real motive of the killing of Halback was sexual homicide
