    "Intelligence tests banned in California when assessing African American students as mildly retarded" (Henley, 2009). "A judicial decree in California prohibited IQ testing of African American students when making an educational assessment for a mild intellectual disability" (Larry P. v. Riles, 1979).

  • SMITH v. ROBINSON

    SMITH v. ROBINSON
    Plaintiff argued that their child should be entitled to reimbursement for legal fees obtained from having to file an action in federal court against the school committee and a number of state officials. "They asserted, at various points in the proceedings, claims for declaratory and injunction relief based on state law, on the Education of the Handicapped Act" (www.caselaw.findlaw.com). Defendant stood by the decision to no longer pay for the child's special education program.
  • Honig v. Doe

    Honig v. Doe
    Plaintiff Doe, a 17 yr old student claimed that his expulsion was in violation of the stay put provision within the Education for All Handicapped Children Act. Respondent Bill Honig felt that when creating the EAHCA children that presented dangerous tendencies was not considered.
    Court ruled that there indeed was a violations and ordered an injunction and that Doe be placed back into his classroom until the review from his IEP. Honig appealed to the Supreme Court.
