  • Brown vs Board Of Education

This landmark Supreme Court case declared state laws establishing separate public schools for Black and white students to be unconstitutional. Although not directly about special education, the decision set a precedent for the desegregation of schools and laid the groundwork for later cases advocating for the rights of students with disabilities. It emphasized the importance of equal educational opportunities for all students.
  • Pennsylvania Association for Retarded Children (PARC) v. Commonwealth of Pennsylvania (1971)

The court ruled that the state must provide free public education to all children, regardless of their disabilities, setting a precedent for future federal legislation like the Education for All Handicapped Children Act of 1975 (later renamed the Individuals with Disabilities Education Act, IDEA).
