James Scobie, a miner is murdered outside the Eureka Hotel which is owned by James Bentley, who was charged with Scobie's murder.

Johann Gregorious (a servant of a priest), was arrested for not having a licence despite being a servant and not a digger. He was charged with assaulting the officer which was impossible as he was disabled and could not assault an able-bodied officer.

A license hunt is ordered, however miners refuse to present them so the miners throw rocks at the troopers who fire shots. As a result, work is suspended on the goldfields. Another meeting was held by Peter Lalor, the miner's new leader. Hundreds of people swear an oath to defend their rights and liberties under the Eureka Flag.
The Eureka Stockade (barricade) is erected. -
Soldiers attack the stockade in the early morning when only 200 miners were present. The battle lasted a few minutes and 22 miners and 5 soldiers were killed.
